Legal Statement

Orders will not be dispatched until payment in full has been received and PASTEL POSY is satisfied with the integrity of the order.

It is your obligation to enter the correct delivery address details at the time of ordering. If the delivery details you have given are incorrect PASTEL POSY  will not refund. Should you wish to send the flowers again it will be at full expense to the customer.

1. Cancellation of Orders

​

1.1 Should you need to cancel your order, money will be refunded less a $15 administrative fee, ONLY IF notice is received by PASTEL POSY 24 hours prior to the scheduled delivery date.

1.2 Cancellations received with less than 24 hours notice will be charged at 50% of the total order value. We are unable to cancel orders that are already prepared and are with our courier for delivery.

2. Refunds

2.1 If you deem flowers or products purchased from us to be faulty we will replace your flowers/product or refund your money subject to the following:

- Email us with your concerns and attach a photo of your good/s within 48hrs of receiving the good/s.

- Flowers or products wont be replaced if we haven't been notified within 48hrs.

- If we have been notified within 48hrs and are agreeable with your concerns we will replace or refund the purchase amount less any courier costs.

Note: All refunds for orders placed online or over the telephone are credited back the original credit card on which the order was purchased.

2.2 Refunds for in-store purchases may be processed through the original credit card for which the order was purchased or by EFTPOS only. A voucher to the same amount paid will be issued for all cash purchases.

2.3 Prices of goods and services and delivery and other charges displayed on the PASTEL POSY website are current at the time of display. These prices are subject to variation without notice.

3. Product Substitution /Availability/Purchase of Wine

​

3.1 Please note that with flower orders, some flowers/products /colour /container/plant and hamper items may be substituted based on availability. If this occurs we will fulfil the order to equal or more value if the selected flowers/products are unavailable.

3.2 You must be 18 years of age or older to purchase the 'Not your grandmas' wine and the recipient must be 18 years of age or older.

4. Disclaimer

4.1 Under no circumstances is The PASTEL POSY website liable for loss of profits, whether direct or indirect or any indirect or consequential damage whatsoever suffered by you.

4.2 If The PASTEL POSY website fails to supply services or goods offered by The PASTEL POSY website, The PASTEL POSY website's liability is limited to supplying the services or goods again or if PASTEL POSY website does not supply the services or goods again, the payment of the cost of having the goods or services supplied again.

4.3 The PASTEL POSY website does not warrant expressly or imply that your access to and use of the Site, or any other website linked to this Site will be uninterrupted or error free.

4.4 The PASTEL POSY website does not warrant, expressly or impliedly that any defects will be corrected or that the Site (or any website linked to this Site) or the server which stores and transmits Content to you are free of viruses or any other harmful components.

Terms and Conditions for Fortnightly Flower Subscription Service

 

  1. Introduction

 

By subscribing to our Fortnightly Flower Subscription Service, you agree to comply with and be bound by the following Terms and Conditions.

Please read these carefully before placing your order.

 

  1. Subscription Details

 

  • Subscription Frequency: Subscriptions are processed on a fortnightly basis. New subscribers will be added to the next available fortnightly delivery.

  • Flower Rotation: Each fortnight, a new flower bunch will be delivered. The flowers offered will differ from those in previous weeks as part of our rotation. The rotation refers strictly to the delivery schedule, not a guarantee that flowers will last for two weeks.

 

  1. Delivery

 

  • ONCE OFF delivery: You’ll only pay a once off delivery fee and will receive Free delivery for the remaining duration of your subscription.

  • Delivery Area: Free delivery is available only to selected towns. The list of towns eligible for free delivery will be provided at the time of subscription. Delivery is not available outside these areas or will require an extra ongoing fee.

  • Delivery Timing: Flower delivery will take place every fortnight from the day the order is placed.

  • Delivery Address: Once your order is placed, the delivery address cannot be changed. Please ensure the address is correct before confirming your subscription.

  • The subscription is designed to have a regular delivery to the one address, therefor addresses for deliveries cannot be changed to a different destination.

  • Specific times for delivery cannot not be requested due to the volume of deliveries.

 

  1. Payment and Billing

 

  • Card Payments: Payments for the subscription will be processed every Monday before the scheduled delivery. By subscribing, you authorize us to charge your selected card each fortnight.

  • Failed Payments: If payment is unsuccessful, we may delay your delivery until the issue is resolved.
    You will be notified if this occurs.

 

  1. Card Messages

 

  • Message Requirements: If you wish to include a message with your flower delivery, the message must be submitted at least 24 hours prior to the delivery. Messages submitted after this deadline may not be included in your delivery.

  • If a card message is required, this will be for the once off delivery only. Its is your responsibility to arrange for another card message should you want one with any future deliveries.

  • Flower Rotation Clarification

  • The term "Fortnightly Rotation" refers strictly to the delivery schedule. It does not imply that flowers will last for two weeks. We cannot guarantee the longevity of the flowers beyond the date of delivery. We encourage you to take care of your flowers following our care instructions to prolong their freshness.   1. Cancellations and Refunds

 

  • Subscription Cancellation: You can cancel your subscription at any time. However, if you cancel after payment has been processed for the upcoming delivery, you will still receive the next scheduled delivery.

  • Refunds: We do not offer refunds for subscriptions once payment has been processed.
    If you are unsatisfied with your flowers or delivery service, please contact us, and we will do our best to resolve the issue.

 

  1. Changes to Terms

 

We reserve the right to update or modify these Terms and Conditions at any time. All changes will be communicated via email or updated on our website. Please review these terms periodically to stay informed.

 

  1. Liability

 

While we strive to provide high-quality flowers and excellent service, we are not liable for any issues related to the care or longevity of the flowers once delivered. We are also not responsible for any delay in delivery caused by external factors such as weather, transport issues, or incorrect delivery information provided by the customer.
